Poniższy tekst jest tłumaczeniem artykułu ze szwajcarskiej prasy. Opisuje precedensowy przypadek psychoterapeutki, która mimo braku ukończonych studiów psychologicznych otrzymała prawo do wykonywania zawodu psychoterapeuty w kantonie, w którym te studia są do tego wymagane.

Wykonywała ona swój zawód w kantonie Grisons, którego prawo nie wymaga od psychoterapeuty ukończenia studiów psychologicznych i wystąpiła o poszerzenie jej uprawnień o kanton Zurich. Spotkała się z odmową władz kantonu z powodu braku tych studiów.

Sprawa trafiła do sądu. W finale, Sąd Federalny poparł wyrok Sądu Administracyjnego nakazujący dopuszczenie tej osoby do wykonywania zawodu psychoterapeuty oraz zrewidowanie ogólnej koncepcji szkolenia w zawodzie psychoterapeuty. Nie da się udowodnić - uzasadnia wyrok - że ukończenie przez psychoterapeutę studiów psychologicznych zwiększa ochronę pacjenta, zwłaszcza w sytuacji, gdy prawo dopuszczające ukończenie innych kierunków studiów obowiązuje w większości pozostałych kantonów. Szkolenie psychoterapeutów powinno obejmować podstawową wiedzę i umiejętności psychoterapeutyczne oraz zdobycie wystarczającego doświadczenia w praktycznym wykonywaniu tego zawodu.

Psychotherapy:

Federal Court (of Switzerland, tr.) dismisses appeal of Canton of Zurich against decision of Administrative Court referring to applicability of Single Market Law.

The appeal by the Department of Health of the Canton (of Zurich, tr.) has been dismissed as unfounded on October 13, 2008, by the verdict of the (Swiss, tr.) Federal Court. The Federal Court states that the Administrative Court has been applying the Single Market Law correctly. It further confirms that concerning patient protection, the preconditions for the provision of an approval to practice psychotherapy in the Cantons of Grisons and Zurich had to be graded equally.

A psychotherapist, in possession of a practice permission in the Canton of Grisons, applied for a further permission in the Canton of Zurich, based on the Single Market Law. The Canton of Zurich refused this, as the psychotherapist in her first education did not follow courses in psychology as a main subject, as the health law of Zurich demands. After her training as a primary school teacher, she followed university studies abroad in psychotherapeutic psycho­logy, where she gained psychotherapy relevant basic knowledge, as well as psychothera­peutic skills considered as sufficient by both Cantons. She also has substantial experience in psychotherapeutic practice.

The Federal Law does not see any evidence that – as the Canton of Zurich demands – studies in psychology as a main education should guarantee a higher level of patient protection com­pared to regulations, which also allow alternatives, as is the case in the majority of the other Cantons. The overall conception of education should be evaluated instead: Scientific basic education with psychotherapeutic basic knowledge, psychotherapeutic skills and sufficient experience in practicing.

The Swiss Charta for Psychotherapy is pleased about this decision and sees itself confirmed in its basic attitude that university graduates of different social and human sciences should be admitted to an education in psychotherapy, as long as they have completed their primary education with psychotherapy relevant basic knowledge. This does not require an entire main course in psychology. We expect that this verdict and assessment of equal value of the dif­ferent cantonal regulations will find its consideration in the draft of the professional psy­chology law for the regulation on the Federal level of psychotherapy.
